1. In consideration of participating in The Nature of . . . Retreat Series (the “Retreat”), I agree and acknowledge that I am fully aware that participation in the Retreat may involve certain physical, emotional, mental and/or other risks and I accept any and all risks of participating. I represent that I am in good physical and mental health, a level appropriate to participate in, and am fully capable of participating in, the Retreat. 2. I, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release and forever discharge any and all liability, claim, demand or action that I may have resulting from injury (physical, mental or otherwise), death, loss (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain or illness), or damages arising from my participation in the Retreat, including but not limited to activities on the Retreat property, outdoor and recreational excursions, workshops or meditation sessions which shall include but not be limited to loss or harm that may be caused by negligence now or in the future, against Steph Jagger, Steph Jagger LLC or her or its successors, agents, licensees, volunteers, third-party affiliates, contractors, assistants, administrators or assigns (collectively, the “Released Parties”). 3. I release and discharge the Released Parties from any and all liability, claim, demand or action that I may have related to the loss, theft or damage of any of my personal property during or while travelling to/from the Retreat. I’ve been advised to obtain travel insurance to offset any such costs. 4. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19 and all of its variants. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. The participant knowingly and freely assumes all such risks related to illness and infectious diseases, such as COVID-19 and all of its variants, even if arising from the negligence or fault of the Released Parties and/or their facility partners; 5. I am aware and understand that a medical clinic may not be immediately proximate to the Retreat. In the event I am injured while participating in the Retreat, I agree to assume all financial obligations for any and all medical costs I incur. If medical or dental care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered and I hereby claim full responsibility for any applicable costs associated with such care. I’ve been advised to obtain medical insurance to offset any such costs and will inform Steph Jagger of any information regarding my insurance that she may reasonably need to know. 6. The Released Parties are hereby authorized to portray, reproduce, photograph, film and/or otherwise use my likeness, image, face and/or voice (“Likeness”) at times deemed appropriate during the Retreat, in the Released Party’s sole discretion, with no further payment, compensation or other obligation to me, and I grant all right, title and interest of every kind and nature whatsoever to use my Likeness, for any lawful purpose including without limitation for marketing and trade purposes in perpetuity, throughout the universe.. I agree that my Likeness may be used, reproduced, displayed, exhibited, published, edited or distributed by Steph Jagger LLC at its sole discretion including in electronic, Internet based or any other public settings. 7. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. 8. I have fully read and understand this Agreement and have had an opportunity to seek independent legal counsel if I so choose. I am aware that by signing this Agreement, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Parties. 9. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington and the federal laws of the United States of America applicable therein and the parties hereto irrevocably attorn to the courts of the State of Washington in or close to Seattle, Washington. BY SIGNING BELOW, I acknowledge that I understand, accept and agree to the terms and provisions contained in this Agreement.
